This Legal Notice governs access to and use of viwabarcelona.com (the “Website”). The sale of products through the Website is governed separately by our Terms & Conditions.

2. Acceptable use of the Website

By using the Website you agree to use it lawfully and in good faith and, in particular, not to: (a) engage in activities that are unlawful or contrary to good faith and public order; (b) publish or transmit content that is unlawful, defamatory, discriminatory, racist, xenophobic, pornographic, that infringes the rights of minors or that violates human dignity; (c) introduce or spread viruses or any other harmful code, or otherwise damage the systems of VIWA, its suppliers or third parties; (d) access or attempt to access accounts or restricted areas without authorisation; or (e) impose an unreasonable burden on the Website’s infrastructure. VIWA may remove any content that breaches these rules.

3. Intellectual and industrial property

The VIWA brand, logos, designs and all contents of the Website (texts, images, graphics, software) are owned by VIWA or its licensors and are protected. You may view the contents for personal, non-commercial use only; their reproduction, distribution, public communication or transformation, in whole or in part, for commercial purposes and without VIWA’s prior written authorisation, is prohibited.

4. Links to third-party websites

The Website may contain links to third-party sites, provided solely for your convenience. VIWA does not control and is not responsible for the content, products or services of those sites, and the presence of a link does not imply any endorsement. Where VIWA becomes aware that a linked resource is unlawful or harmful, it will act diligently to remove or disable the link.

5. Availability and liability

VIWA makes reasonable efforts to keep the Website available and its content accurate and up to date, but does not guarantee uninterrupted availability or the absence of errors or viruses. To the extent permitted by law, VIWA is not liable for damage arising from the unavailability of the Website or from technical faults, errors or harmful code beyond its reasonable control. Nothing in this Legal Notice excludes or limits any liability that cannot legally be excluded towards consumers.

6. Registration and accounts

If you create an account, you undertake to provide truthful, accurate and up-to-date information and not to impersonate any other person. You are responsible for keeping your access credentials confidential and for any activity carried out through your account; please notify us without delay of any unauthorised use.

7. Right of exclusion

VIWA may deny or withdraw access to the Website, without prior notice, to anyone who breaches this Legal Notice or where it is reasonably necessary for security reasons.

8. Data protection

The processing of personal data through the Website is governed by our Privacy Policy and Cookie Policy, in accordance with the GDPR and the Spanish Data Protection Act (LOPDGDD).

9. Governing law

This Legal Notice is governed by Spanish law. This choice of law does not deprive you, as a consumer, of the protection afforded by the mandatory provisions of the law of the country in which you have your habitual residence (art. 6(2) of Regulation (EC) No 593/2008, “Rome I”). In relation to consumers, the mandatory jurisdiction rules under consumer protection law apply (generally, the courts of the consumer’s place of residence).
